LIMITED PRODUCT WARRANTY
TBR warrants all of its products against defects in materials or workmanship for a period of two years from the original date of purchase by the consumer (the “Warranty Period”). TBR does not warrant and is not responsible for any product not purchased through TBR's official sales network or directly. If a material or manufacturing defect occurs in any product and a valid claim is filed within the Warranty Period, TBR will (1) repair the product using new or refurbished parts or (2) replace the product with a new or refurbished product. For purposes of this limited warranty, "refurbished" means any product or part that has been substantially returned to its original specifications. In the event of a defect, these are your exclusive remedies.
EXCLUSIONS AND LIMITATIONS
Except for the limited warranty set forth above or to the extent limited or prohibited by applicable law, TBR expressly disclaims any and all other warranties express or implied, including any warranties of quality; merchantability, or fitness for a particular purpose, and you specifically agree that TBR is not responsible for any special, warranty, indirect, punitive, or consequential damages for breach of any warranty of any kind on any product. Except and without limiting the generality of the above disclaimers, the limited warranty does not, under any circumstances, cover the replacement or cost of any electronic device or personal property inside or outside the product.
For end users covered by applicable copyright law of the consumer or regulation in their country of purchase or residence, the benefits to the end user under this limited warranty are in addition to the end user's other rights and remedies under such laws or regulations. These benefits may include additional warranties or rights related to the performance of this product and the remedies applied in the event of a defect. This limited warranty should be interpreted in accordance with the laws or regulations applicable to the end user in any state, province or country and any provision of this limited warranty that conflicts with those rights or the benefits of end users does not apply to end users covered by such law or regulation, so the exclusions and limitations set forth in this limited warranty may not apply, or may not be fully applicable, to you.
UNIQUE AND EXCLUSIVE INDEMNIFICATION
Your sole and exclusive remedy for any breach by TBR of this Limited Warranty, as well as TBR's full and exclusive liability for such breach, is, at TBR's option, to repair or replace the defective product or, if the warranty claim is made during the first thirty (30) calendar days of the warranty period, will refund the purchase price of the defective product. Its repair or replacement applicable product (including parts and labor, as well as the cost of reshipping) shall be at TBR's expense. TBR reserves the right to send you a replacement product that is of the same or similar type as the product returned from the limited warranty or a substitute equivalent to your original product which may not be of the same type (subject to availability). Replacement products should be provided on an exchange basis only. Replacement or repair products are covered in warranty as above only for the remainder of the original validity period of the warranty.
GET WARRANTY SERVICE
If you wish to make a claim hereunder Limited Warranty with respect to a product, please contact by mail at info(at)tbrmotorsport.com, by phone, and request an RMA. All of the above information is necessary for a warranty claim to be accepted. Once the Company validates your application, we will issue you an RMA number and shipping information from info(at)tbrmotorsport.com.
Please note that TBR cannot accept returns on packages without an RMA number. Your RMA Number must be clearly marked on the outside of the packaging containing your returned product. By returning a product without an RMA number you waive your rights and release TBR from all obligations under the limited warranty, even if proof of delivery is available, due to our inability to match your purchase with the returned product – so, if you can send us a package without the RMA number clearly marked on the outside of the package, you understand and acknowledge that you will also lose the product in the package and any applicable remedy you would have received under the limited warranty.
DISCLAIMER OF WARRANTY
Except as expressly set forth above in this product limited warranty article, each product is provided solely on an "as is" basis and TBR makes no other warranty of any kind. To the fullest extent permitted by applicable law, TBR expressly disclaims and excludes any and all other warranties, whether express, implied or statutory, including without limitation any implied warranties of non-infringement, merchantability or fitness for a particular purpose. If the disclaimer of any implied warranty is not permitted by law, the duration of any such implied warranty is limited to the duration of warranty period of the limited warranty as defined above. Some jurisdictions do not allow the exclusion of implied terms disclaimers or limitations on the duration of an implied warranty may last, so these limitations or exclusions may not apply to you. If applicable law provides for a minimum warranty period that is longer than the warranty period set forth in a limited warranty, then the warranty period for products subject to such applicable law must comply with the minimum period required. This warranty gives you specific legal rights and you may have other rights that vary from country to country.
